These Terms of Use (“Terms”) govern your access to and use of the Propnavigator website and services (“Platform”). By registering, browsing, or otherwise using our Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform immediately.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you (“User”) and Propnavigator (“Company”, “we”, “our”). By creating an account, submitting a listing, or enquiring about a property, you confirm that you are at least 18 years of age, legally capable of entering into contracts, and agree to abide by all applicable laws of India.
2. Nature of the Platform
Propnavigator is an online real estate marketplace that facilitates property discovery, listing, and connection between buyers, renters, sellers, and registered agents. We act as an intermediary and are not a party to any transaction between users. All property details, pricing, availability, legal clearances, and representations are the sole responsibility of the listing agent or owner.
We do not provide legal, financial, tax, or investment advice. Users should conduct independent due diligence and consult licensed professionals before making any real estate decision.
3. User Accounts
- You must provide accurate, complete, and current information when registering.
- You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
- You must notify us immediately of any unauthorized access or suspected breach of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misrepresent information.
4. Property Listings
Agents and property owners who submit listings agree that:
- All listed information is accurate, truthful, and does not infringe third-party rights.
- Properties must hold valid legal title, all required approvals, and — where applicable — RERA registration.
- Listing prices, carpet areas, amenities, and possession dates must reflect current, factual conditions.
- Fraudulent, duplicate, or misleading listings will be removed without notice and may result in account termination.
- All newly submitted listings are subject to admin review and approval before going live on the Platform.
5. Agent Registration and Approval
Individuals wishing to list properties as agents must register through our “Free Listing” program. Agent accounts are activated only upon review and approval by our team. We reserve the right to reject or revoke agent status at our discretion, particularly in cases of misrepresentation, non-compliance with RERA, or violation of these Terms. Agents are solely responsible for ensuring their listings comply with the Real Estate (Regulation and Development) Act, 2016 (RERA).
6. Enquiries and Communications
When you submit an enquiry or download brochure request through our Platform:
- You consent to being contacted by the relevant agent, owner, or our team via the details you provide.
- You may receive follow-up calls, emails, or WhatsApp messages regarding the property or related services.
- You can opt out of marketing communications at any time by contacting us or using the unsubscribe option in emails.
7. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent property listings or user profiles.
- Scrape, crawl, or systematically extract content or data from the Platform without prior written consent.
- Circumvent any security feature or access control mechanism on the Platform.
- Use the Platform for money laundering, benami transactions, or any activity prohibited under Indian law.
- Harass, abuse, or threaten other users, agents, or Propnavigator staff.
- Post spam, unsolicited advertisements, or pyramid scheme links.
8. Intellectual Property
All content on the Platform — including the Propnavigator logo, website design, text, graphics, software, and compiled property data — is the intellectual property of Propnavigator or its licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. Property images submitted by agents remain the property of the submitting party; by uploading, you grant us a non-exclusive, royalty-free licence to display them on the Platform.
9. Disclaimers
The Platform is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding:
- The accuracy, completeness, or currency of any property listing or price.
- The legal status, title clearance, or RERA compliance of any listed property.
- Uninterrupted or error-free operation of the Platform.
- The conduct, reliability, or identity of any agent or property owner listed on the Platform.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Propnavigator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform — including but not limited to property transaction disputes, financial losses, inaccurate listing information, or third-party conduct. Our total liability in any matter shall not exceed ₹5,000 or the amount you paid us in the preceding 12 months, whichever is lower.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra. We encourage resolution of disputes through good-faith negotiation before initiating legal proceedings.
12. Modifications to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Platform after the posting of changes constitutes acceptance of the revised Terms. We recommend checking this page periodically.
